TESKA GLOBAL PRODUCTION S.R.L., hereinafter referred to as "UNIKA" or the "Controller", attaches great importance to your personal data, constantly taking the necessary steps to ensure that the data processing carried out complies with the legal requirements in this area. To this end, we have drawn up this commitment by which we undertake to respect the confidentiality of your personal data and by means of which we explain to you what categories of personal data UNIKA processes, how that data is used and the purpose for which it is subject to processing operations.

This Policy relates only to the personal data that we process through our website www.horecabyunika.com (hereinafter referred to as the "Site" or "Platform") in the context of your interaction with it by filling in the forms available on the Platform, placing an order, subscribing to the newsletter or when you are just browsing it. The web Platform is addressed to Business to Business (B2B) relationships, but the data retrieval carried out by the Controller concerns the data of the contact person or representative of the company that wants to enter into a commercial relationship with the Controller, data that fall under the protection granted by the GDPR. We want to assure you that we have taken all necessary measures to ensure the confidentiality of your data, which is processed only by the Controller’s staff who have been previously trained and authorized to process personal data and who respect firm confidentiality commitments.

Your data is processed by UNIKA in a secure manner, meaning that the Controller has implemented a series of technical and organizational measures, adequate to protect personal data against incidents such as: destruction, loss, accidental or unlawful alteration, unauthorized use, disclosure or access, in particular when the processing involves the transmission of data over a network, as well as against any other form of unlawful processing.

To "get to know" us virtually, we provide you with our identification data.

The Controller that processes your personal data when you browse or interact with the online platform www.horecabyunika.com is TESKA GLOBAL PRODUCTION S.R.L., having its registered office in Jud. Ilfov, Comuna Clinceni, Soseaua de Centura 3C, registered with the Trade Register under number J23/4862/2020, with Sole Registration Code 32473767. For any questions/enquiries regarding the protection of personal data you are invited to send a request to the postal address indicated above or to the e-mail address contact@horecabyunika.com. Persons sending such requests to UNIKA are requested to mention in the subject of the e-mail/on the envelope information such as "data protection", "GDPR", "personal data", as in this way there is a guarantee that requests will be treated with priority.

In this capacity, you will receive a response within 30 days at the latest from the communication of the request to UNIKA, and an extension of this deadline can operate only in exceptional situations. In these cases, we assure you that you will be duly informed of this deadline.

2. DEFINITIONS

"Personal data" means any information relating to an identified or identifiable natural person. An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity.

   For the purposes of this policy, personal data that will be subject to processing may relate to: last name, first name, telephone number, e-mail address, etc., as described below.

 "Processing of personal data" means any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure to third parties by transmission, dissemination or otherwise, alignment or combination, blocking, erasure or destruction.

  For the purposes of this policy, data processing refers to those processing operations carried out at the time of your navigation on the website (...) or interaction with it by filling in the forms available on the Platform, subscribing to the newsletter or purchasing products available on the Platform, as a representative or contact person of the company.

"Controller" means the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data.

   For clarity, for the purposes of this Privacy Policy, the Personal Data Controller is UNIKA.


   "Data Subject" means the person whose personal data are being processed.

   For the purposes of this Policy, the data subject is the Internet user who browses the website www.horecabyunika.com or places an order through it, as a representative or contact person for the purchasing company. 

"Consent" of the data subject means any freely given, specific, informed and unambiguous statement of the data subject's wishes by which he or she accepts, by a statement or by an unambiguous action, that personal data relating to him or her may be processed.

   The data processing carried out via the Platform and based on the legal basis of consent is exclusively for the purpose of subscribing to the newsletter, i.e. accepting cookies other than those that are necessary (essential), as highlighted in the cookie widget, respectively detailed in the Cookie Policy.


 "Third party" means a natural or legal person, public authority, agency or body other than the data subject, the controller, the controller's authorized representative and persons who, under the direct authority of the controller or the controller's authorized representative, are authorized to process personal data.


 "Person authorized by the controller" means the person who processes personal data on behalf of the controller. This may be represented by the Controller's partner companies, such as companies providing website maintenance, legal, marketing services, etc.


3. WHAT TYPES OF PERSONAL DATA DO WE PROCESS AND FOR WHAT PURPOSES?

Your browsing and interaction with the Site involve the processing of two categories of personal data, namely:

  1. personal data that you voluntarily disclose to the Controller (e.g. via the order form or in the case of newsletter subscription), which are collected on an individual basis;
  2. data that you provide unintentionally by simply browsing our website.

UNIKA collects the following personal data on the basis of the voluntary provision of the data subject:

A. In case of placing an order, as the contact person:

- last name and first name;

- phone number;

- e-mail address;

- postal delivery address, in case the personal address is provided and not the address of the company's registered office.

 We draw attention to the fact that data belonging to a legal person is not personal data (e-mail address of the company such as denumire@office.ro, telephone number of the company such as landline number, address of the registered office or place of business, etc.) in the light of the provisions of Regulation no. 679/2016 on the protection of personal data (GDPR).

 In case the personal data of the company representative/contact person (last name and first name, telephone number, e-mail address) are provided, he/she will be considered as the data subject according to the GDPR and all protection measures will be applicable.

 B. To subscribe to the newsletter

Subscribing to the newsletter is conditional upon your consent to receive commercial and marketing messages from the Controller. Providing your e-mail address for subscription to the newsletter, by filling in the specific forms, represents your consent to receive commercial and marketing communications from the Controller. You may withdraw your consent at any time by clicking on the "Unsubscribe" button on each e-mail sent by the Controller or by sending a request to this effect to the e-mail address: contact@horecabyunika.com. You may also unsubscribe from the newsletter by accessing the specific section, "Unsubscribe newsletter", at the bottom of the website.

In the context of newsletter subscription, the e-mail address, as well as the first name and last name (indirectly, if resulting from an e-mail address such as nume.prenume@x.ro) will also be processed as personal data.

 C. Requesting a quotation

To request a quotation from Unika, the Controller requires the following personal data:

- last name and first name;

- e-mail address;

- phone number;

- any other data you provide by filling in the "Leave us a message" box.

D. Making telephone calls

The following personal data may be processed in the context of making inbound or outbound telephone calls:

- last name and first name;

- phone number;

- e-mail address;

- delivery address and billing details, if they do not belong to a legal person;

- voice.

All these data contribute to the provision of services offered by UNIKA, as well as to the communication with the Controller or the transmission of marketing communications on its behalf, but only with the prior consent of the user, as detailed in the Newsletter Subscription Policy.

The data subject is duly informed about the processing of personal data when he/she provides the Controller with his/her data through the forms on the website, respectively through this Policy, thus UNIKA fulfilling its legal obligation of information, as Controller.

The Controller also processes marketing and communication data only with the prior consent of the users, as well as technical data and browsing actions through cookies and similar technologies.

In the event that you provide us with personal data that is not necessary for the purposes described in this policy, we reserve the right to immediately remove it from our database.

The Controller may also unintentionally collect other personal data belonging to you, namely: IP address, browser version, time and location settings, operating system, platforms on the devices used to access our Site, etc. This information will not be used to identify individuals or legal entities, as the case may be, and will not be made public except as set out in this Privacy Policy, supplemented by the Cookie Policy.

The Controller reserves the right to request additional information from you, accompanied by supporting documents, by e-mail, in printed form or in any other way deemed appropriate by the Controller, if necessary.

Your personal data may be communicated by UNIKA for processing to persons authorised to process them, including contractual partners, financial authorities and institutions, courts or competent bodies, at their request and for the purpose of providing the services and products offered by the Controller.

UNIKA may store your personal data even after you have registered a request for deletion of such data, if the storage is done for one of the following purposes, provided for in Article 13 of the GDPR, namely:

  1. performance of a contract;
  2. fulfilment of a legal obligation providing for processing under European Union law or national law applicable to the controller;
  3. the exercise of the right to free expression and information;
  4. protecting the vital interests of data subjects;
  5. the fulfilment of a task that serves the public interest;
  6. archiving in the public interest, scientific or historical research or for statistical purposes;
  7. the defence of the legitimate interests of the Controller or of a third party, except where the interests or fundamental rights and freedoms of the data subject require the protection of personal data, in particular where the data subject is a child;
  8. to establish, exercise or defend a right in court.

4. FOR WHAT PURPOSE AND ON WHAT LEGAL GROUND DO WE PROCESS PERSONAL DATA?

UNIKA processes your personal data for the following purposes and on the following legal grounds:

  1. processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract (Art. 6 (1)(b) of Regulation (EU) no. 679/ 2016 of the European Parliament and of the Council of 27 April 2016), in particular, for the purpose of ensuring the access of the data subject, as a representative or contact person for the purchasing company, to the products marketed on the www.unika.com.ro Platform and of concluding the online selling;
  2. processing is carried out on the basis of the consent of the data subjects (Art. 6, (1)(a) of Regulation (EU) no. 679/ 2016 of the European Parliament and of the Council of 27 April 2016) in the case of the transmission of commercial and marketing communications;
  3. processing is necessary for the purposes of the legitimate interests pursued by the Controller (Art. 6 (1) (f) of Regulation (EU) no. 679/2016 of the European Parliament and of the Council of 27 April 2016), for the resolution of problems of any kind relating to the content of the www.horecabyunika.com  website or the services offered by the Controller, as well as for actions involving interaction with the online platform;
  4. the processing is necessary for the fulfilment of a legal obligation (for example, tax obligations) incumbent on the Controller - Article 6 (1) (c) of Regulation (EU) no. 679/2016 of the European Parliament and of the Council of 27 April 2016).

Your personal data will be processed for UNIKA to:

a. improve the website and the services provided through it;

b. determine the usefulness/popularity of the web content presented on the site;

c. send technical, assistance or administrative notifications;

d. honour requests and resolve complaints received from users;

e. facilitate user access to the products and services offered by UNIKA;

5. DURATION OF PROCESSING OF PERSONAL DATA

Personal data processed at UNIKA through the website www.horecabyunika.com are retained for a reasonable period of time in relation to the purpose of data processing, in accordance with the legal provisions on data archiving.

For example, if you are a customer of the Controller, the latter will process your data for the entire duration of the contractual relationship and after its termination, in accordance with the legal obligations incumbent on UNIKA. Also, in the case of financial-accounting supporting documents, these are archived at the Controller's level in accordance with the law, for a period of 10 years from their issue.

6. TRANSFER OF PERSONAL DATA

Your data is processed on the territory of the European Union, through secure internal servers. However, by means of plugins specific to social networks (e.g. Facebook, Instagram, etc.), as third-party recipients of the data, it is possible that your data processed in this context may also be transferred outside the European Union/European Economic Area and stored on servers in third countries. In this regard, the Controller has implemented a number of necessary and appropriate measures to ensure that the data is processed accordingly.

UNIKA undertakes that the data collected will be processed only in accordance with the stated purposes and will not make public, sell, rent, license, transfer, etc. in an unauthorized manner the database containing information on the data of the data subjects to any third party not involved in the fulfilment of the stated purposes, unless the transfer/access/display, etc. is requested by the competent authorities, in cases provided for by the regulations in force at the time of the event.

Your data may be disclosed to other companies that provide services to us and act as our data processors, such as providers of website maintenance, IT, legal, marketing services, etc.

These entities are selected with great care to ensure that they comply with specific personal data protection requirements. They have a limited ability to use your information for purposes other than providing services to us.

In addition to the disclosures described in this Privacy Policy, we may disclose information to third parties to whom you consent or request that we make such a disclosure.

7. LINKS, HYPERLINKS, THIRD-PARTY SITES

If you connect to a third-party website, UNIKA's privacy policy will not apply to your browsing on that website.

8. WHAT ARE YOUR RIGHTS AS A DATA SUBJECT?

Any natural person browsing our website, as a data subject, has the following rights in relation to UNIKA, as a Personal Data Controller:

  •  right of access means the right of the data subject to obtain confirmation from the Controller as to whether or not the Controller is processing personal data relating to him or her and, if so, to have access to that data and to information on how the data are processed;
  •  right to rectification refers to the correction, without undue delay, of inaccurate personal data processed or to their completion if they are incomplete. They can be amended by sending an e-mail to: contact@horecabyunika.com
  •  right to erasure of data/the right to have them deleted ("right to be forgotten") from the database means the right of the data subject to request the deletion of personal data without undue delay if one of the following grounds applies: they are no longer necessary for the purposes for which they were collected or processed, he/she withdraws his/her consent and there is no other legal basis for the processing, he/she objects to the processing and there are no overriding legitimate grounds, the personal data have been unlawfully processed, the personal data must be deleted for compliance with a legal obligation, the personal data have been collected in connection with the provision of information society services;
  •  right to restriction of processing may be exercised if the data subject requests the restriction of the processing of his/her personal data, in which case they will be used strictly for the exercise of the data subject's other legal rights, including to respond to any requests/complaints from the data subject;
  •  right to portability refers to the right to receive personal data in a structured, commonly used and machine-readable format and the right to have such data transmitted directly to another controller when the processing is based on consent or performance of a contract and is carried out by automated means, if technically feasible;
  •  right to object refers to the right of the data subject to object to the processing of personal data when the processing is necessary for the performance of a task carried out in the public interest or when it concerns a legitimate interest;
  •  right to object to data processing on the basis of automated individual decisions refers to the fact that the data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or similarly affects him or her to a significant extent. However, it will not be possible to exercise this right if the decision is necessary for the conclusion or performance of a contract between the data subject and UNIKA, is authorised by the law applicable to the Controller, provided that adequate protection of the rights, freedoms and interests of data subjects is ensured or is based on the consent of the data subject obtained in compliance with applicable law;
  •  The right to address the National Supervisory Authority for Personal Data Processing. If the data subject considers that the above-mentioned rights have been infringed, he/she has the possibility to address the ANSPDCP by lodging a complaint.

9. FINAL PROVISIONS

If UNIKA deems that a change in the privacy rules is necessary, the Controller will publish those changes to inform data subjects about the information it collects and how it uses it.

The provisions of the Privacy Policy are supplemented by the provisions of the Cookie Policy and the Newsletter Subscription Policy, respectively, present on the website www.horecabyunika.com.
